Before I. A. Mowat, Esq

Hannrpitoy & Ca, v. Ya-coun, Claim of $18; for Rent.

M. Cussumbhoy, sworn, stated that he was manager of the Plaintiff's firm and, in their name, sued for the present claim of $15, which was rent for'a house payable to them by the defendant, who was one of their tenants. The house is situated in market lane and was Ict to the defendant who entered on the Ist January and in possession. A new agreement had been entered into on the Ist April, whereby, in consideration of the rent being raised and paid in advance, extensive repairs were to be made by the plaintiffs. The rent was to be $9 per month, and defendant has not paid for the mouths of April or May, though stipulated that the rent should be paid monthly in advance.

The defendant stated that he was obliged, owing a bad drain and a bad roof, to get some repairs done, the cost of which amounted to $12, which he desired to have taken off the claim; as it was understood that all extensive repairs were to be paid for by the plaintiffs. Ifa however that he had not actually paid anything for repairs as yet.
