It is believed that the High Court's decision to order the release of the seamen's leaders Messrs. Walsh and Johannsen, which was unanimous and awarded the. costs to applicants, was based on the view that the section of the Immigration Act under which the deportation proceedings had been conducted was ultra vires as contrary to the Australian Constitution Act.
