Full Court Refuses to Grant Leave to Appeal An application for leave to appeal by Karam Singh (alias Durga Dass), Rattan Singh and Sadhu Singh against a life sentence for an assault with intent to murder was dismissed by H.M. Full Court of Appeal, consisting of Judge Sir Allan Mossop, Judge R. E. Lindsell (of Hongkong) and Judge P, Grant Jones, yesterday Mr. John McNeill appeared on behalf of the Crown Advocate.
Judge Mossop, giving judgment, said that sentence was passed by the Supreme Court on January 12, 1937, when the three men were convicted and sentenced, on a charge of wounding with intent to murder, to life imprisonment with hard labour. In their application for leave to appeal, the appellants had filed several grounds, The Court had considered these and found that they amounted to no more than a re-statement of the plea which was put forward to the jury at the trial. One of the defendants put forward an alibi, the. other two denied they were present.
The Court felt that there was abundant evidence to justify the jury arriving at its verdict, and that the verdict and sentence were not unreasonable. Leave to appeal, therefore, would be refused.
