Playing had been in progress for a couple of hours, when E found necessary to leave the game due to circumstances beyond his control. His absence was acquiesced by the four remaining players. On his return, the players informed him that, during his absence, C had struck a premium (4 of a kind) and C was therefore entitled to a premium stake, E refused to pay up, basing his refusal on the follows ing facts:

(1) He left the game, due to circumstance beyond his control.

The players acquiesced to his request to. withdraw temporarily.

agreement or under; standing was made to the effect that a premium stake had be paid whether a person withdrew temporarily' from the game or not, On the other hand C advanced the following facts why E should pay up, and these are: (1) Temporary withdrawal from the game did not give E the privilege to suspend payment of premium stake, In previous games, the absent player paid' up the premium stake if a "four of a kind" was struck by any player.
