The Codo of Customs Regulations and "Procedures, chapter XVII, explains that expos ranted' the cie question (page 209)
Your note implies that. privileged factory registration is granted. to Chinese and foreign factories on the same conditions without discrimin tion, and if the rules laid down in chapter XXViI_ of the Customs Code were followed, this would be correct, However, these rules are not followed and there is definite
factories in regard' to. privileged lvcrinination againat foreign factory registration, Since 1927 registration as. priyileged factories has been refused foreign concerns on the ground that they have not been registered under Chinese Company Law, As is well Known the representatives of "thi Treaty Powers in China have a vised the Chinese Government that the demand put forward" by the Chinese Government, that foreign companies registered under the laws of the various Treaty Powers, should register under Chinese company Jaw, cannot be complied with as such registration would conflict with the treaties made by the various Treaty Powers, 'The. principal. pr the concerns registered as privileged duty. This is a very veal privilege factories, exemption from export indeed, and a great. handicap when non-privileged factories compete with' privileged factories, Your note mentioned above would ive the impression to readers not sequainted with the facts that the Chinese Government are endeavour ing to treat Chinese and foreign concerns alike. This is not so and the matter of granting privileged factory treatment. is only one many cases where flagrant dis ination is practised by the Chinese Government. It is important that facts in regard. to discrimination against foreign interests fare kept in mind and that the foreign communities in China are not misinformed in regard to these matters. T therefore hope that you will be good enough to publish the above in your Journ Shanghai, Mar, 19,
