Mr. Rudolf W. Mayer, entering the witness-box, said that' Mr. H.W. Howell (then the receiver) visited him in May, 1996, and asked him to Invest some' money in the company. He sent a chartered accountant round to investigate, and the latter advised him not to put any money into the firm. There were possibilities, how-fever, if the company were re-organ-fod, and Mr. Mayer agreed to put some money into it if the company were so re-organized, there was a breach of contract the part of Mr, Mayer and that they. were defrauded of their rights by means of fraud, wilful misrepresentation and false, pretences.
