In connection with the extortion charge the complainant's wife had not implicated him in any way. Kelly then told the Court that he had gained six awards during his service and had received six punishments. The awards included a commendation for arresting a gang of murderers while the offences entered against him had been committed during his first three years in the force when he was a young policeman, None of them were serious.
Referring to the release of the C! nese, Kelly said that this would heve been regular had Sub-Insp. Darters entered it. Verhovsky did not enter it as it would have made Sub-Inso. Darters look careless. He added that there was a certain amount of friction between the plain-clothes branch and the uniformed men, There were arguments between the two branches and a certain amount of jealousy.
The hearing was then adjourned until tomorrow et 2.30 p.m.
'LAUNING a total of $118,084.: 55 for alleged breach of contract, Mr, Loh Nan-tsao, contractor, represented by Mr. M. Reader Harris, is the plaintiff and Mr. H. M. Joseph, represented by Mr. J. R. Jones, is the defendant in an action heard by Judge Sir Allan Mossop, in H.M. Supreme Court yesterday. The hearing, which lasted the whole day, was adjourned to 10 a.m., today, after Mr. Reader Harris had examined his client in the witness box, while Mr. Jones was able to start his cross-examination.
In compliance with the terms of a written agreement signed between the two parties on June 12, 1937, plaintiff was to supply material and labour for the construction of an apartment house on Avenue Joffre, at a price of $293,000 and the building was to be completed on or before June 16, 1938, Mr. Harris stated in opening his pleadings.
According to the agreement, plaintiff was to receive payments for the work completed and materials bought upon presentation of the usual certificate issued by the architects, Messrs. Davies, Brooke & Gran, it being understood that 20 per cent. of all amounts due should be withheld until six months after the completion of the building, while the amounts payable at any one time would have to be over $10,000, Mr. Harris added.
On November 3, 1937, the first statement amounting to $31,051 was presented, but only $15,000 were paid defendant, Mr. Harris added, although he would have been entitled to receive 80 per cent. of the original amount. The balance thus due, Mr. Harris continued, was to have been paid his client upon resumption of work which was interrupted as a result of Sino-Japanese hostilities.
