S. J. Minty Vill Case Concluded

Judge Mossop Finds That Widow Did Not Sign. as

"Attesting Witness"

"On the evidence before me I am satisfied that Mrs. Minty did not intend to sign her husband's will as an attesting witness," said Judge Sir Allan Mossop in H.M. Supreme Court (Probate Jurisdiction) yesterday. Accordingly, he said, he would direct the Letters of Administration with Will "to go as prayed, omitting the name of Mrs. Mint:

The judgment was as'follows:—This is an application by Johanna Minty, the widow of the late Sidney Joseph Minty deceased, for leave to apply for Letters of Administration to the estate of the deceased in China with the will of the deceased dated January 25, 1938 annexed, but omitting therefrom the signature "Johanna Minty" appearing at the foot of the will.

The evidence shows that for some time prior to his death on January 26, 1938 the late Mr, Minty was a patient at the Paulun Hospital at Shanghai, On the evening of January 25, 1938 Mr. Minty informed his doctor that he wished to make a Will, Mr. Minty was very weak at the time, but perfectly conscious and of sound mind.
