S, David in a claim for $24859 for rent and eleetr city" charges, Plaintiff was represented by Mr. E, T. Maitland.
Mr, David admitted his indebted. ness for: rent, pointing out that he had never received statements from the Shanghai Power Company regard-jing the electricity charges although it had been agreed with plaintiff that the should receive such bills.
Defendant went on to say that should have been charged $8.00 for October electricity consumption and $14.10 as stated on the writ, which {stated 47 cents per unit for a certain [period which, Mr. David said, did not correspond to the actual charge which was 43.93 cents. He produced a slip of Paper with figures which, he said. he jotted down from information. he obtained at the power company. His Lordship pointed out that this was inadmissible unless defendant was going to call someone from the com:
Pany to prove the document, 'Mr. David then applied for relict from' payment of court costs on the ground that he had written to Mr. Maitland asking for a clarification of the accounts, but_had received no 20 reply. He also referred to an action the Chinese court which, he said. was brought against plaintiff by #01 eral of the tenants for employing threats and for leakage in the premises. Plaintiff he declared, hast called in loafers and threatened to beat them all up and had cut' off their water supply and threatened to cut off their light. He admitted owing plaintiff $143. and judgment was given against him for that for arrears of rent.
At the same session the court heard jan action brought by the same plaintiff against Mr. Hf. V. Rowland. The claim was for $204.98 representing rent and electricity charges. Judgment was given against defend-fant for $135 for rental duc with costs.
