Murder Charge in

Court Yesterday Pic. Gerald E, Casement, of the

4th Regiment U, S, Marines, was arraigned in the U. S, Court yesterday on a charge of killing Floyd Allan Sebastian, a 15-month-old baby. on March 12. Casement pleaded not guilty to the charge, read by Judge Milton J, Helmick, and the case was adjourned until a lawyer could be appointed for the defence by the court, since the accused is unable to pay for legal advice, The short hearing took place in a crowded courtroom, some commotion being caused towards the end by Mrs, Sebastian, mother of the dead child, ahd wife' of Casement, who burst into Years, and nearly fainted in the corridor. Later in the day it was announced that Mr. H. G, Nelson had been appointed to represent Casement.

Casement came into the courtroom shortly before 10 o'clock, escorted by two Marines. He sat down quietly in the court, and showed no signs of emotion despite the many curious eyes turbed on him, When Mr, Leighton Shields, the 'District Attorney, came into the room he spoke briefly' to Casement, who answered in monosyllables, and seemed completely indifferent, "Not Guilty"

"When Judge Helmick entered he the age used to stand up while the' read the chafges against him. Casement stood up, and the judge [said that the District Attorney, Mr. Leighton Shields, had died an arraignment against him in which it was charged that Casement was subject to the jurisdiction of the United States Court for China and had deliberately, with malice aforethought, killed one Floyd Allan Sebastian, low do you say, guilty or mot guilty 2" he asked, "Not guilty," replied Casement clearly, Accused was then asked whether he was represented by counsel, and on replying in the negative was asked whether.he wished the court to procure counsel for him, He agreed to this, stating that he had not the means to obtain a lawyer himself, The hearing was then adjourned, Mrs, Sebastian who had listened, apparently quite' unmoved, to the proceedings, started crying when Casement was removed by his escort, and had to be helped into the corridor outside the courtroom. She nearly fainted outside, and was taken into the room of the Deputy Marshal, where she was assisted, It will be recalled that at the inquest into the death of the baby, both Casement and Mrs, Sebastian refused to testify, and the coroner, Mr, N. E. Lurton, found that the child had died from criminal assault "inflicted by one Gerald E, Casement between the hours of 7 p.m. on March 12 to 430 am. on March 13, 1941."
