The new film hit by the producer of "Ninotchka"
Now the Court of International Justice has a dual function, judicial and advisory, advisory opinion was given by the Court to the Assembly of the League upon disputes or questions upon which the opinion of the Court was required. Twenty seven such opinions have been given. The jurisdiction of the Court is. of course. a jurisdiction between States; only States which have signed the protocol, or have complied with certain other conditions can appear before the Court. This does not mean, however, that personal interests cannot be pleaded before the Court. A State which is of the opinion that one of its subjects has been wronged by another State can make his case its own and institute proceedings against the other State.
This was done in the case of an Englishman who had started a river transport business ju the Belgian Congo and who considered that his rights had been infringed by c virtual monopoly which the Belgian Government had granted to a competing Belgian undertaking; an opinion which was not shared by the Court.
And here is a point worth remembering: a state which feels wronged. either as a state, or in the person of One of its members, can only invoke the jurisdiction of the Court with the assent of its adversary. There are four different ways in which this assent may be obtained: in the first place two states can agree to submit a specific dispute to the Court; in the second place states which conclude a treaty can include therein a clause to the effect that disputes arising under the treaty shall be settled by the Court The other two ways in which a State can submit its case to the Court are by means of the General Act and the Optional Clause.
The General Act of 1908 was a is herd It's swell!
