At the re-hearing Mr. Toeg withdrew his claim to half of the Leupoo Creek, and assented to his claim being stated as follows Area of land to be surrendered 2m, If. 91. 5h. at Ts. 2,000Ts Return of one-fourth-cost of culverting creek ale 1,175 Return of cost of road making 400

Ts Weihaiwei Road Extension, After very careful consideration of everything brought forward by Mr. Toeg the Commissioners see no reason to alter their finding of the 16th April, namely, that the Om. 7f. 5). 4h. required for road be surrendered froe, but that Mr. Toeg be refunded Tls. 400, for making _up road over it, and they hereby confirm that decision.

Note—If Mr. Toeg had made a road entirely on his own laud, say 20 feet wide, the value of the land so taken Im. Gf. Ol.° Oh. would have been Tls. 3,200 to which would have to be added the cost of making up and metalling the road, whereas the cost under award is follows For land surrendered Om. 7f.

Tis, 2,683

Thus whilst the cost is less he has the additional benefit of a road double the width that gives more direct access to! the Settlements and which he is at no expense to'malse up or metal, Seymour Road Extension.

The Commissioners' finding of 16th Add for compulsory sal April was based on the assumption that Total amount of claim Tls. 7,276 this extension was not objected to by Mr. Toeg, which was apparently incorrect as Mr. Toeg at once wrote saying ho Awaiting the favour of your early could not accept the award, on the reply. ground that he was not aware that this We are, Dear Sir, extension was to be brought before the Yours faithfully, Scorr & Canren. Commissioners, and that he never intended to make a free surrender of the land Cuanues Mayne, Esq., required (see his letter, 19th April).
