Us. Court for China

laun for Wages Judgment A decision in the case of G. P. Sternberg v. the China Finance Corporation was given by Judge Milton Helmick in the U.S. Court for China," on Monday, Mar. 25, The case, which' was "heard several weeks ago, dealt with the plaintiffs claim for _com= pensation alleged to be due for ger-Vices rendered in connection with Knit-to-ft Mill, taken over by' the defendants on a mortgage foreclosure, Mr. N. F. Allman represented th plaintiff and "Mr. C. 8. Franklin the Getendants, In his "memorandum, the Judge, after reviewing the evidence, stated the basis for his decision as follows:

"The evidence leads the Court to believe that plaintiffs motive in remaining wrelaker was not his belief that he would be compensated for the amount he sues for, but be" cause he was primarily interested in financing the reopening of the mill, When the mill was in operation before defendants took It over, plaintiff and his wife received for a short time a maximum salary of $460, plus quart ers, and they offered to continue with [defendants at. the same figure. Hence, does not seem reasonable that, after the mill was closed, they should expect to receive $580, plus quarters, Apart from his wife's salary, plainti has received from defendants $1,420 money and_good:

"The plaintiff is entitled to recover reasonable compensation and, if his wife's salary Is not to be taken into consideration, as plaintiff insists it should not be, it becomes dimeult to appraise the value of his Kol vices, because of the continuous joint aspect susceptible of segregation or accurate mathematical calculation, From all the circumstances, the Court believes plainti is fairly entitled to approx imately $980-and consequently: judgment will be rendered for that Jamount, with costs."
