Judgment was reserved by Judge P. Grant Jones in H.M. Supreme Court yesterday morning when the hearing of the action broüght by Mr. Solomon Zatz, a Russian sperviser employed by the American Securities Corp, against Mr. F. Marshall, member of the Shanghai Stock Exchange and prominent local jockey, was concluded.
"Mr. Zatz, represented by Mr. K. E. Newman, claimed a sum of $1000 as damages $392.60 as special damages, and costs, resulting from an accident on Bubbling Well Road on June 17, when he states that he was thrown out of a rickshaw and sustained serious injury through the defend: ant's car colliding with the rear of the rickshaw. Plaintiff, for whom Mr. H, D. Rodger conducted the case, denied any negligence and said that the accident was caused by a sudden swerve made by the rickshaw coolie.
Continuing his cross-examination of defendant Mr. Newman was told that the rickshaw was occupying far more of the road than it should have done. Here the Judge stated that if the road was clear the puller was entitled to use as much of it as he wished. This was the law although such archaic conveyances were not used there (England).
