After defendant had pleaded not guilty to the charge, Mr. McDonald told the court that on August 3 complainant was conversing with one Jagat Singh, in the market when defendant came up to Jagat Singh and asked him whether he had got his job through his brother or the complainant. The latter, counsel said, will testify that defendant was under the influence of liquor at the time. Upon Jagat Singh replying that he didn't know, Counsel continued, the accused "savagely hit him on the head with a heavy stick."
Counsel went on to relate how complainant fell to the ground in a semi-unconscious state with blood pouring profusely from head. Supported by Jagat Singh, he went to the Hongkew police station and made a report before going to the General Hospital where five stitches were put on his scalp. When he returned later to the station, counsel said, accused abused him and chal-longed him to go out and fight. Defendant was arrested and detained in a cell for the night.
In consequence of the alleged assault, counsel added, his client had been suffering from headaches and general nervousness. © Counsel successfully applied for an adjournment until tomorrow morning, after pointing out that complainant was still unwell and could not do justice to himself by giving evidence immediately.
