The application by McMullan (Agencies) Ltd., was on the same form of motion, Mr. Jones said. It concerned an agreement covering the deposit of title deeds and called for an advance of $32,000 of which $10,- 000 had at present been made. This, too, was registered with the British Consulate at Chefoo and, for similar reasons to the other two agreements, was not registered with the Registrar of Companies during the required period.
The Judge, after commenting that Article 165 of the China Order-in-Council did not apply to the companies, but only individuals and that the former had to register all such matters with the Registrar of Companies, in accordance with the Hongkong, Companies' Ordinances in the case of local companies and in accordance with the Companies Act of 1929 in the case of companies registered in London. After receiving the Crown Advocate's assurance that "he had been instructed not to oppose the motion," he said that the same order, mutatis mutandis, would be as under the first motion. The order as to costs would be the same.
