Japanese Firm Sued For Commission

Mitsubishi Named in Big Aeroplane Deal San Francisco, July 16.

Mr. Edward Cummins, American exporter, filed suit in court here yesterday against the Mitsubishi Shoki Kaisha Corporation for $265,000 commission on 40 Lockheed planes of which 14 were of a type easily convertible into bombers.

The suit alleged that in April, 1936, the Lockheed Ca. agreed to pay him ten per cent. of the sales price on all planes sold to the Japan Air Transport Ca. and the Manchoukuo Air Transport Ca. The sales were said to have totalled $2,850,000, making his commissions $285,000.

Mr. Cummins previously sued Lockheed and Mitsubishi jointly but dropped proceedings against Lockheed when the American company paid him $20,000.—United Press.
