The Asia Realty Company first drew the defendants' attention to the erection of the wal, with a gateway of about six feet wide, on May 81, 1089, and requested that this gateway might be widened to 29 feet to allow motorcars and trucks of normal size to pass. In its reply to this letter, the Bank wrote that this wall was erected at the Public Works Departments request, who, however, denied that any such request had been made.
In pronouncing judgment, His Lordship declared that the plaintiff "was entitled to reasonable access and ordered the defendant to pull down part of the wall erected to an extent of not less than 29 feet.
The plaintiff was represented by Mr. J. McNeill, while the defendants" case was in the hands of Mr. C. E. Sherwin.
